What constitutes "identity" remains contested. Identity includes gender, race, religion, ethnicity, culture, nationality, political affiliation, sexual orientation, etc., and these categories are often subject to regulation by state authorities. While some states may seek to recognize all identities equally, others might privilege specific ones. This tension between diversity and uniformity creates complex challenges for societal cohesion and individual autonomy.

How can human rights frameworks ensure that everyone enjoys their constitutional right to self-expression? Can such frameworks effectively prevent discrimination based on identity, or is it an impossibility?

Let us define self-expression. Self-expression involves communicating one's inner thoughts, feelings, ideas, beliefs, values, opinions, and experiences through various mediums such as speech, writing, art, music, dress, appearance, etc. It also entails the freedom to decide how to present oneself publicly without fear of persecution, judgment, or censure. The concept has its roots in liberalism's emphasis on individual liberty and equality before the law.

We must consider the ways in which identity is policed. States have different laws, policies, and cultural practices regarding how individuals present themselves publicly.

Some countries prohibit homosexuality while others legalize same-sex marriage. Some cultures require women to wear headscarves, whereas others allow them to dress freely. These differences create a range of restrictions on self-expression, making it difficult to determine if they are justified.

We need to ask: what constitutes "identity"? Is it merely how one chooses to express oneself, or does it include inherent characteristics like race and gender? If so, then how do we balance the rights of those who feel oppressed by these identities with the freedoms of those who do not recognize them?

The realization of freedom of self-expression presents complex challenges for societies policing identity. While human rights frameworks may provide protection against discrimination based on identity, they cannot fully ensure that everyone enjoys their constitutional right to self-expression. Still, they play an important role in promoting diversity, tolerance, and respect for difference.

To what extent can human rights frameworks ensure individual freedoms such as expression in cultures that place constraints on identity expressions? The main issue is whether or not it is possible for human rights frameworks to guarantee unrestricted expression in societies where social norms dictate how people should behave, feel, think, and express themselves.
